Please read these Terms of Service carefully before using Salon Assist CX. By creating an account or clicking "I Agree," you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Stylist," "User," or "Subscriber") and Salon Assist CX ("Company," "we," "us," or "our") governing your access to and use of the Salon Assist CX platform, including all related websites, applications, and services (collectively, the "Service").
By registering for an account, you represent that you are at least 18 years of age, have the legal authority to enter into this agreement, and are using the Service for lawful business purposes.
Salon Assist CX provides an AI-powered appointment scheduling and client management platform designed for independent hair stylists and beauty professionals. Features include but are not limited to: online booking pages, AI chat booking, appointment management, client profiles, email notifications, and scheduling tools.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify subscribers of material changes.
3.1 Subscription Fee. Access to the Service requires a paid subscription at the current rate of $30.00 USD per month (or such other amount as may be updated with notice). Your subscription begins on the date of your first payment.
3.2 Automatic Renewal. Your subscription automatically renews each month on your billing anniversary date unless you cancel prior to the renewal date. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.
3.3 Failed Payments. If a payment fails, we will attempt to collect payment and may suspend or terminate your account for non-payment. You remain responsible for all amounts owed. Suspended accounts may lose access to their data after 30 days of non-payment.
3.4 No Refunds. All subscription fees are non-refundable except where required by applicable law. Cancellation stops future charges but does not entitle you to a refund of amounts already paid.
3.5 Price Changes. We reserve the right to change subscription pricing with at least 30 days' advance notice. Continued use after a price change constitutes acceptance of the new pricing.
3.6 Cancellation. You may cancel your subscription at any time through your account dashboard or by contacting us. Cancellation takes effect at the end of your current billing period. You will retain access to the Service through the end of the paid period.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
You agree not to share your account with others, resell access to the Service, use the Service to operate a competing product, or use the Service in any unlawful manner.
The Service is a scheduling and communication tool only. Salon Assist CX makes no representations, warranties, or guarantees of any kind regarding the business outcomes, revenue, client retention, booking volume, or commercial success of any subscriber. Results will vary based on individual business practices, market conditions, and factors entirely outside our control.
We do not guarantee that the Service will increase your client base, reduce no-shows, improve client satisfaction, or produce any particular financial result. Any examples, case studies, or projections shared in our marketing materials are illustrative only and not a guarantee of your results.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE.
We do not warrant that the Service will be error-free, secure, or continuously available. Scheduled and unscheduled downtime may occur. We are not responsible for missed appointments, lost bookings, or client communications resulting from Service interruptions or technical issues.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SALON ASSIST CX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
You acknowledge that you are an independent business operator and that Salon Assist CX is not your employer, partner, or agent. You are solely responsible for:
Salon Assist CX is not liable for any dispute, harm, or claim arising between you and your clients.
You retain ownership of your client data stored within the Service. By using the Service, you grant us a limited license to store, process, and use that data solely to provide the Service to you.
You are responsible for obtaining any necessary consents from your clients regarding the collection and storage of their personal information. You agree not to store sensitive financial data, medical records, or any information that violates applicable privacy laws.
Upon account termination, you may request an export of your data within 30 days. After 30 days, data may be permanently deleted.
The Salon Assist CX platform, including its design, code, AI models, and branding, is owned exclusively by Salon Assist CX and protected by applicable intellectual property laws. You may not copy, reverse engineer, or create derivative works based on the Service.
You retain all rights to your own content, including your profile information, photos, and client data.
We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, fraudulent activity, or any conduct we determine to be harmful to the Service or other users, with or without prior notice.
Upon termination, your right to access the Service immediately ceases. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 5, 6, 7, and 9.
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved through binding arbitration in Nashville, Tennessee, except that either party may seek injunctive relief in a court of competent jurisdiction.
We reserve the right to update these Terms at any time. We will notify subscribers via email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
